Returns and complaints

Right to withdraw from the Agreement

​

A Customer who is a consumer, i.e. a natural person who has concluded an Agreement not directly related to his or her business or professional activity, has the right to withdraw from the Agreement, without giving a reason, within 14 days.

​

The period for withdrawing from the Agreement begins:

​

a) in the case of an Agreement under which the Product is delivered to the Customer - from the date the Product (the first of the ordered Products - in the case of subscription) is taken into possession by the Customer or a third party indicated by him, other than the carrier;

​

b) in the case of the Agreement, the subject of which is the delivery of digital content that is not delivered on a tangible medium (e.g. e-books downloaded directly from the Store's website) - from the date of conclusion of the Agreement.

However, the Customer who is a consumer has no right to withdraw from the Agreement:

​

a) the subject of which is the delivery of newspapers, periodicals or magazines, the consumer has the right to withdraw from the Subscription Agreement;

​

b) the subject of which are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;

​

c) for the supply of digital content that is not recorded on a tangible medium (e.g. e-books downloaded directly from the Store's website), if the performance of the service (i.e. downloading digital content by the Customer from the Store's website) began with the Customer's express consent before the deadline to withdraw from the Agreement expires and after the Seller informs him about the loss of the right to withdraw from the Agreement; However, the Customer has the right to withdraw until the Seller has completed the service, i.e. until the Customer downloads the digital content from the Store's website.

A customer who is a consumer may withdraw from the Agreement by submitting a declaration of withdrawal from the Agreement to the entrepreneur. This declaration may be submitted on the form, the template of which is attached as Annex 1 to the Regulations.

To comply with the 14-day deadline, it is enough to send the declaration before its expiry.

A declaration of withdrawal from the Agreement may be submitted:

​

a) in writing and sent to the following address: Uri Wollner, Co.Phi, ul. Hoża 58/60, 00-682 Warszawa; or

​

b) by e-mail to: sklep@cophi.pl.

​

If the Customer submits a declaration of withdrawal from the Agreement by e-mail, the Seller immediately confirms to the Customer, also by e-mail, confirmation of receipt of the declaration of withdrawal from the Agreement.

​

In the event of withdrawal from the Agreement, the Agreement is deemed not to have been concluded. The Seller is obliged to immediately, no later than within 14 days from the date of receipt of the Customer's declaration of withdrawal from the Agreement, return to the Customer all payments made by him, including the costs of delivery of the Product. However, if the Customer has chosen a delivery method other than the cheapest one offered for a given Product in the Store, the Seller is obliged to refund the Customer only the costs of this cheapest delivery method.

The Seller may withhold the refund of payments received from the Customer until he receives the item back or until the Customer provides proof of sending it back, depending on which event occurs first.

​

The Seller refunds the payment to the Customer using the same payment method used by the Customer, unless the Customer has expressly agreed to a different method of return, which does not involve any costs for him.

​

In the event of withdrawal from the Agreement, the Customer is obliged to return the Product to the Seller immediately, but no later than 14 days from the date on which he withdrew from the Agreement. To meet the deadline, it is enough to return the Product before its expiry.

The product should be sent to: Uri Wollner, Co.Phi, ul. Hoża 58/60, 00-682 Warszawa. In the event of withdrawal from the Agreement, the direct costs of returning the Product are borne by the Customer (i.e. packaging and shipping costs).

The Customer is liable for any reduction in the value of the Product resulting from using it in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.

Complaints

​

The Seller is obliged to deliver the Product without defects.

​

The Seller is liable to the Customer if the Product has a physical or legal defect (warranty), in accordance with Art. 556 et seq. Civil Code.

​

In the event of Product defects, complaints may be submitted:

​

a) in writing to the following address: Uri Wollner, Co.Phi, ul. Hoża 58/60, 00-682 Warszawa or

​

b) by e-mail to: sklep@cophi.pl.

​

The complaint should include: name and surname of the Customer submitting the complaint, date of delivery of the Product to the Customer, contact details, description of the defect, and the Customer's request.

​

In a complaint, the Customer may demand:

​

a) remove the defect (repair) of the Product;

​

b) replacing the Product with a defect-free one;

​

c) price reduction;

​

d) withdraw from the Agreement if the defect is significant.

​

However, the Customer may not withdraw from the Agreement if the Seller immediately and without excessive inconvenience to the Customer replaces the defective Product with a defect-free one or removes the defect. However, if the Seller has already replaced the Product with a new one or removed the defect, the Customer may withdraw from the Agreement.

The Seller responds to the complaint to the address or e-mail address provided by the Customer within 14 days of submitting the complaint.

​

If the Customer requests removal of the defect, replacement of the Product with a defect-free one or withdraws from the Agreement due to the defect, he or she is obliged to return the Product at the Seller's expense to the address indicated in point 3(a). a) above. However, if the basis for the complaint is the destruction or damage of the Product causing its unfitness for use, it is sufficient to send it by e-mail to the address indicated in point 3(a). b) above a photo of the Product showing destruction or damage, without the need to return it to the Seller.

A customer who is a consumer who is dissatisfied with the way a complaint is handled may use extrajudicial methods of dealing with complaints and pursuing claims, in particular he may submit to the appropriate Provincial Inspectorate of Trade Inspection a request for mediation or a request for the case to be heard before an amicable consumer court. Final Provisions

​

The Regulations may be changed, in particular in the event of a change in the law. In the event of a change to the Regulations, the Seller will post on the Store's website information about the publication of the amended version of the Regulations and the date of its entry into force. The amended Regulations enter into force no earlier than 14 days from the date of their publication on the Store's website.

​

In matters not regulated in the Regulations, the relevant legal provisions shall apply, in particular the Act of May 30, 2014 on consumer rights and the Civil Code.
